This document provides general website Terms & Conditions for a UK charitable foundation with online content, event bookings and donations. It is not legal advice. Please have a solicitor review before publishing.

2. Acceptance of these terms
2.1 By using hoppersfoundation.co.uk (the "Site"), creating an account, booking an event, or making a donation, you agree to these Terms & Conditions (the "Terms").
2.2 If you do not agree, do not use the Site.
2.3 We may update the Terms from time to time. Changes apply from the date posted on this page. We will note material changes at the top of this page.
3. Other terms that apply
3.1 Our Privacy Policy and Cookie Policy explain how we process personal data and use cookies.
3.2 If you are a business supporter, the "Business Supporters" provisions in Section 14 also apply.
3.3 If you enter competitions or promotions, any Promotion Terms will apply in addition to these Terms.
4. Eligibility & accounts
4.1 You must be at least 18 to make donations or bookings. Under‑18s may use the Site only with a parent/guardian.
4.2 You are responsible for keeping your account credentials confidential and for all activity under your account. Inform us immediately of any unauthorised use.
5. Using the Site
5.1 You agree not to misuse the Site, including by: (a) breaching applicable law; (b) infringing intellectual property; (c) uploading harmful code; (d) scraping or data‑mining without our written consent; (e) attempting to gain unauthorised access; or (f) interfering with the Site’s operation.
5.2 We may suspend or terminate access if we reasonably believe these Terms have been breached.
6. Information on this Site
6.1 We aim to keep information accurate and up to date but do not warrant that content is complete, accurate or current.
6.2 Advice or information on the Site is general only and not a substitute for professional advice.
6.3 Images are illustrative; colours and packaging may vary.
7. Intellectual property
7.1 The Site and its content (text, graphics, logos, videos, marks and software) are owned by us or our licensors and are protected by intellectual property laws.
7.2 You may view, print and download content for your personal, non‑commercial use only.
7.3 You may not copy, reproduce, modify, distribute, display, sell or exploit content without our prior written consent.
7.4 If you submit content (e.g., comments, reviews, photos), you grant us a worldwide, non‑exclusive, royalty‑free licence to use, reproduce, modify, publish and display that content in connection with the Site and our work, and you warrant that you have the right to grant this licence.
8. Event bookings (camps, community sessions, fundraisers)
8.1 Your booking is confirmed when we send a booking confirmation.
8.2 Cancellations by you. Unless otherwise stated on the event page, you may cancel up to14 days before the event for a full refund.
8.3 Cancellations by us. If we cancel or materially change an event, we will offer a full refund or a transfer to a similar event. We are not responsible for your travel or accommodation costs.
8.4 Participant responsibilities. You must comply with venue rules and any health & safety instructions. For physical activity events, you confirm you are fit to participate and will inform us of relevant medical information.
8.5 Safeguarding. For activities involving children or vulnerable people, our Safeguarding Policy applies. Parents/guardians must provide accurate emergency contact details.
9. Donations & Gift Aid
9.1 Donations are voluntary and non‑refundable, except where a mistake has been made; please contact us within 14 days.
9.2 If you opt into Gift Aid, you confirm you are a UK taxpayer and understand that if you pay less Income/Capital Gains Tax than the amount of Gift Aid claimed, it is your responsibility to pay any difference. You must tell us if your tax status, name or address changes.
10. Business supporters & sponsors
10.1 This Section applies to business supporters and sponsors only.
10.2 Payment terms. Unless otherwise agreed in writing, invoices are due within 14 days of the invoice date. We may charge interest on late payments at 4% per annum above the Bank of England base rate, accruing daily until paid.
10.3 Warranties. To the fullest extent permitted by law, all implied terms are excluded. Our total liability for loss or damage arising out of or in connection with a contract shall not exceed the price paid for the sponsorship/support package giving rise to the claim.
10.4 Set‑off. You shall pay amounts due without set‑off or deduction.
11. Third‑party services & links
11.1 The Site may link to third‑party websites, platforms (e.g., payment processors, ticketing providers) or social networks. We are not responsible for their content or policies.
11.2 Your use of third‑party services is subject to their terms.
12. Accessibility
12.1 We strive to meet recognised accessibility standards and welcome feedback to improve the Site’s accessibility.
13. Liability
13.1 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be limited or excluded by law.
13.2 Consumers. We are responsible for foreseeable loss and damage caused by us. We are not liable for business losses.
13.3 Businesses. Subject to 13.1, we exclude liability for loss of profit, revenue, business, goodwill, and all indirect or consequential loss.
13.4 We do not guarantee the Site will be secure or free from bugs or viruses.
14. Suspension & termination
14.1 We may suspend or terminate your access to the Site or any services if you materially breach these Terms or where we are required to do so by law or a regulator.
15. Complaints & dispute resolution
15.1 We aim to resolve complaints quickly. Please contact us using the details in Section 1.
15.2 If we cannot resolve a consumer complaint, you may refer to an Alternative Dispute Resolution body or use the Online Dispute Resolution (ODR) platform. This does not affect your statutory rights.
16. Governing law & jurisdiction
16.1 These Terms are governed by the laws of England and Wales.
16.2 The courts of England and Wales shall have exclusive jurisdiction, except that consumers resident elsewhere in the UK may bring claims in their local courts.
